When Kansas passed its law treating students the same regardless of immigration status with regards to qualification for in-state tuition, the big question was how many students who are undocumented immigrants would take advantage of the law.
Kris Kobach predicted 2,667 undocumented students (or as he calls them, illegal aliens) could flood Kansas colleges, taking untold dollars. Supporters of the law said it would be far fewer.
Now, Jim Sullinger of The Kansas City Star has the answer:

Twenty-two of them go to community colleges; only eight go to Regents schools.
So Kobach was off a little bit. But not by much...only about 8900%.
In fact, Kobach has almost as many plaintiffs on his case -- 24 -- as there are students using the new law. Given the low usage of the law, it is more than likely that Kobach's lawsuit will actually cost Kansas taxpayers more than the undocumented students he's suing over.
Now remind us again which party is supposedly against "frivilous lawsuits"?
